We shall ship the product to the physical address that you have provided on our order form as soon as your payment has cleared in our bank account. This depends on the time that transfers take from one bank to the next. We ignore proof of payment and will only respond by releasing the goods when we have received confirmation of the funds in our bank account. This could take as long as four days. Should you have made a payment via credit card then we shall ship as soon as Payfast informed us of the payment (normally in the next working day).
Hawkins’ support policy is that a standard repair charge per product applies for products manufactured after 2008. Products older than 10 years does not qualify under the standard repair charge policy and a quotation for a replacement product should to be requested.
Shipping costs related to any repair to and from Hawkins is for your own account. However, Hawkins will pay the return to you shipping costs if the product is in the 2 year warranty period.
Hawkins reserves the right to refuse any repair of a product regardless of age, that has been modified, tampered with, struck by lightning or in a poor condition due to misuse, damage, mishandling, dropping or operating it outside of specification. We advise to contact our Service and Repairs department to establish that a product is in a condition worth repairing, thus saving you unnecessary shipping costs to and from Hawkins.You may want to e-mail us a photo of the product condition should you be unsure whether it would be allowed.
Procedure for Warranty Returns/Claims
To identify the procedure for returning product sold by Hawkins Manufacturing (Pty) Ltd. judged to be faulty for replacement and to ensure that all costs associated with the return are minimised.
1. Hawkins Manufacturing (Pty) Ltd. warrants to you, the customer, that the products will be free from defects in materials and workmanship for a two-year period after the date of purchase. If Hawkins Manufacturing (Pty) Ltd. receives notice of such defects during the warranty period, Hawkins Manufacturing will, at its option, either repair or replace products that prove to be defective. Replacement products may be either new or like new. (see: Method below)
2. Hawkins Manufacturing (Pty) Ltd. does not warrant that the operation of the product will be uninterrupted or error free. If we are unable, within a reasonable time, to repair or replace any product to a condition as warranted, you would be entitled to a credit of the purchase price upon prompt return of the product.
3. Hawkins Manufacturing (Pty) Ltd. will pay the return shipping costs pertaining to products accepted under the warranty return policy.
4. Warranty does not apply to defects resulting from:
(a) Modification, adjustments, repairs, tampering or misuse,
(b) Consequential damage to the product,
(c) Improper installation,
(d) Used in unsuitable environments,
(e) Used in applications outside that specified in the scope of the product.
Hawkins Manufacturing (Pty) Ltd. makes no other expressed warranty or condition whether written or oral. To the extent allowed by local law, any implied warranty or condition of merchantability, satisfactory quality, or fitness for a particular purpose is limited to the duration of the expressed warranty set forth above.
If a product is considered to be faulty, it should be returned to Hawkins Manufacturing (Pty) Ltd. for rectification. The returned product shall include a full kit of parts. If an incomplete product is returned, or there is no proof of purchase date, then it will not qualify for warranty but as a standard repair.
On receipt of the considered faulty product, compliance with warranty acceptance will be verified and a fault analysis will be carried out.
If the product qualifies under the warranty criteria outlined above, the product will be repaired or exchanged and returned to you. Hawkins will pay the return freight charges.
If the product does not qualify under the warranty criteria outlined above, then a standard repair cost will apply for that particular product. Once repaired the unit will be returned to you via courier and you will be charged for cost of returning the product to you.
You may select to collect the repaired product from Hawkins should you want to avoid incurring courier costs.
An invoice for said repair and shipping cost shall be payable on presentation and the repaired product will be shipped to you after the funds have been received.
To the extent allowed by local law, the remedies in this warranty statement are your sole and exclusive remedies, except as indicated above. In no event will Hawkins Manufacturing (Pty) Ltd. be liable for injury, loss of life, loss or damage to property, data or for direct, special, incidental, consequential (including lost profit or data), or other damage, whether based in contract, tort or otherwise.
This information is subject to change without notice and is provided “as is”. Hawkins Manufacturing (Pty) Ltd. shall not be liable for any direct, indirect, special, incidental, or consequential damages in connection with the use of this document or products.
We reserve the right to:
Modify or withdraw, temporarily or permanently, the web site (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Web site; and/or
Change these Conditions from time to time and your continued use of the Web site (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Web site.
We will use our reasonable endeavours to maintain the Web site. The Web site is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the Web site or because of failure, suspension or withdrawal of all or part of the Web site due to circumstances beyond our control.
We have the right, but not the obligation, to monitor any activity and content associated with the Web site. We may investigate any reported violation of these Conditions or complaints and take any action that we deem appropriate (which may include, but is not limited to issuing warnings, suspending, terminating or attaching conditions to your access and/or removing any materials from the Web site).
The Conditions will be exclusively governed by and construed in accordance with the laws of South Africa whose Courts will have exclusive jurisdiction in any dispute, save that we have the right, at our sole discretion, to commence and pursue proceedings in alternative jurisdictions.
Updating of these Terms and Conditions
We reserve the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this web site. It is the User’s obligation to periodically check these Terms and Conditions at the Web site for changes and updates. The User’s continued use of this Web site following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.
I undertake not to copy/duplicate the designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to be in violation of this agreement I understand that I will be held liable for all legal costs incurred by Digisec for any civil action or any legal action deemed necessary against me.
